Terms & Conditions

Introduction

These Terms and Conditions ("Terms") apply to the Enfuze application ("Application"), operated by Enfuze Technologies Private Limited ("Enfuze", "we", "us", or "Service Provider").

By downloading, accessing, or using the Application, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Application.

About Enfuze

Enfuze is a collaboration platform that enables Brands and Influencers to discover each other, communicate, negotiate, and execute influencer marketing campaigns.

Enfuze acts solely as a technology intermediary and does not:

• Act as a talent agent.
• Act as a legal advisor.
• Guarantee campaign performance or outcomes.

Eligibility

By using Enfuze, you confirm that:

• You are at least 18 years old.
• You have the authority to act on behalf of the brand, if applicable.
• All information provided by you is accurate and up to date.

Account Registration & Authentication

Users may register or log in using:

• Mobile number (OTP-based authentication).
• Email address (OTP or verification-based authentication).

You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activities performed through your account.

Enfuze reserves the right to suspend, freeze, or deactivate accounts in case of misuse, fraud, or policy violations.

Campaigns, Negotiation & Awards

• Campaigns on Enfuze are operational constructs, not legal contracts.
• Negotiations conducted on the platform are informational and non-legal.
• A Campaign Award represents a mutual operational agreement between a Brand and an Influencer.
• Campaign Awards are not legal contracts.
• Users may upload external legal contracts if required.
• Enfuze is not responsible for enforcing off-platform agreements.

Payments & Wallet

Payments are milestone-based as agreed between Brands and Influencers. Enfuze facilitates payment tracking and wallet management but does not guarantee payment unless explicitly stated.

Taxes, invoices, and regulatory compliance are the responsibility of users. Wallet funds cannot be used outside the platform.

Wallet Rules:

• Brands: Can add funds but cannot withdraw funds.
• Influencers: Can withdraw funds but cannot add funds.

Disputes

• Brands or Influencers may raise disputes through the platform.
• Enfuze may freeze campaigns or awards during dispute resolution.
• Enfuze's role is administrative, not judicial.
• Final decisions may be taken by Enfuze to maintain platform integrity.

User Conduct

Users agree not to:

• Provide false or misleading information.
• Engage in fraudulent activity or fake engagement.
• Misuse messaging or negotiation features.
• Attempt to bypass security mechanisms (OTP, lockouts, etc.).
• Upload unlawful, harmful, or infringing content.

Violation of these Terms may result in suspension or termination of your account.

Account Suspension & Termination

Enfuze may:

• Suspend or deactivate accounts.
• Freeze campaigns or awards.
• Restrict platform access.

Users may request account deactivation, subject to pending obligations. No refunds will be issued upon termination.

Application Availability & Updates

• Enfuze may update, modify, or discontinue features at any time.
• Continued use of the Application requires acceptance of updates.
• Enfuze does not guarantee compatibility with all devices or operating system versions.

Limitation of Liability

Enfuze shall not be liable for:

• Disputes between Brands and Influencers.
• Loss of revenue, reputation, or business opportunities.
• Third-party service failures (SMS, email, payment gateways).
• Data loss beyond reasonable control.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Enfuze Technologies Private Limited is incorporated, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to the use of the Application, these Terms, or the services provided by Enfuze shall be resolved through binding arbitration rather than through court proceedings, except where prohibited by applicable law.

Arbitration shall be conducted:

• By a single neutral arbitrator.
• In the English language.
• Through a recognized arbitration body or rules determined by Enfuze.
• At a location determined by Enfuze, unless otherwise required by applicable law.

Nothing in this section prevents either party from seeking injunctive or equitable relief where necessary to protect intellectual property, confidentiality, or platform integrity.

Changes to These Terms

We may update these Terms periodically. Continued use of Enfuze constitutes acceptance of the revised Terms.
